Here is the background. More than 3 years ago I had a mobile phone from 3G, 2 months into the contract it was stolen in New York. Hubby rang them and cancelled the phone and I never asked for or got another one to replace it. The phone was never used after this date. I paid as per my contract every month for the remaining 10 months of the year i had signed up for. Then I wrote cancelling the contract on the non-existent phone.
About 6 months later they passed my debt of £63 - which they said was 2 months contract and a fee onto debt collectors. I rang them and explained that if they wanted to take me to court they should do so, as there wasn't a court in the land that would think it equitable of the phone company to charge me for a contract which had not been in use for so long. Nor would they think it reasonable for the phone company to assume I would renew a contract for line rental when i had neither phone nor sim. They agreed and said they would pass it back to 3G.
This morning I get a letter (sent to my brother in laws address in the North) from another debt collector demanding the £63! I was livid, so I phoned them and was told in no uncertain terms that if I don't pay they will take legal action - I told them to go ahead, and they said at best I would have a default against my name.
My question is this
Should I pay the bloody money just to get them off my back even though I think it is grossly unfair? Would you??
